Jared Polis has signed new legislation expanding Colorado red flag gun law, broadening who can petition a court to temporarily remove firearms from individuals deemed a risk to themselves or others.
Under the updated law, healthcare facilities and schools are now authorized to file petitions for an Extreme Risk Protection Order (ERPO). Previously, only law enforcement and certain family or household members were eligible to initiate these requests.
Supporters say the expansion provides additional pathways to intervene in potentially dangerous situations, particularly when warning signs are observed in medical or educational settings. Critics, however, have raised concerns about due process and the scope of who can initiate such actions.
The law takes effect immediately, meaning the newly authorized groups can begin filing petitions right away.
