The Colorado Bureau of Investigation (CBI) has obtained an arrest warrant for a deputy with the Fremont County Sheriff’s Office following an investigation into an alleged excessive force incident at the Fremont County Jail.
According to CBI, deputy Luis Mora-Huerta is accused of using a prohibited chokehold on an inmate during an encounter inside the jail. Investigators allege Mora-Huerta placed his right hand on the front of the inmate’s neck in what was described as a “C-clamp” position while the inmate was pressed against a wall.
An arrest affidavit states that when the inmate told the deputy, “He’s choking me,” Mora-Huerta allegedly responded, “Yes, I am.” Chokeholds are prohibited for peace officers under Colorado law.
Mora-Huerta is facing misdemeanor charges, including first-degree official misconduct, official oppression, and harassment. Following the filing of charges, he was terminated from his position with the Fremont County Sheriff’s Office.
He is scheduled to return to court next week as the case moves forward.
