The U.S. 10th Circuit Court of Appeals has denied Alison Brown’s “petition for rehearing” in her federal lawsuit against Chaffee County – the third federal court decision against her and presumably her final legal option in this case.
On June 23, 2022, U.S. District Judge Regina Rodriguez dismissed Brown’s lawsuit against the County “with prejudice,” so Brown paid her attorney, Charlie Cain of Austin, Texas,* to appeal the ruling.
On appeal, a three-judge panel with the 10th Circuit Court unanimously affirmed Rodriguez’ decision against Brown.
Cain’s law firm, Cain and Skarnulis, filed a petition on Brown’s behalf, requesting that the 10th Circuit Court’s decision be reconsidered by the original three-judge panel and by all 19 judges on the Court.
Not one of the 19 judges saw grounds to reconsider the previous rulings, seemingly putting an end to the millionaire’s federal claims against Chaffee County and its taxpayers.
In the meantime, Brown has at least one additional lawsuit pending against the County in Chaffee County District Court.
