The Colorado Court of Appeals ruled yesterday that former Mesa County elections clerk Tina Peters must be resentenced in connection with her role in an election security breach.
Peters was originally sentenced to nine years in prison for allowing unauthorized access to voting machines following the 2020 election.
While the appeals court upheld her conviction, judges determined that her sentence was based in part on improper consideration of her right to free speech, requiring the case to be sent back for resentencing.
Peters is currently incarcerated at the La Vista Correctional Facility in Pueblo as the case moves forward.
