A lawyer representing Suzanne Morphew’s daughters has filed a motion in court alleging the State wrongfully took possession of Suzanne’s remains after they had been released to a funeral home for her planned service.
According to the motion, Suzanne’s daughters made arrangements for a funeral after the Chaffee County Coroner released her remains in April 2024. Court documents state the remains were released to a funeral home at the request of her next of kin. However, the filing claims that “without warning and contrary to the prior lawful release,” the State later took possession of the remains before the service could be held.
The motion asks the court to require the State to explain why Suzanne’s remains were taken and why they continue to be withheld. It also seeks a Temporary Restraining Order to prevent further interference with the next of kin’s right to possession and burial, along with the immediate release of the remains so funeral arrangements can proceed.
The development comes as Barry Morphew, Suzanne’s husband and the father of Macy and Mallory Morphew, faces a murder charge in connection with her death. He pleaded not guilty to the charge last month.
The court has not yet ruled on the motion.
