UPDATE: Judge Patrick Murphy has declared a mistrial in the sexual assault trial of Herbert Lucas Scott.

As of 4pm on Tuesday, September 1, 2022, the jury in the case had spent 13 hours deliberating the guilt or innocence of Scott. Judge Murphy asked the foreman if they had made any progress. The foreman answered, “No, we are hopelessly deadlocked.”

A hearing has been set for October 14th to schedule a new trial.

[Original Story] On Thursday, September 1, 2022 at 1 pm, Judge Patrick Murphy called the jury back into the courtroom after 10 hours of deliberation.

Judge Murphy asked the jury foreman if any progress can be made on Scott’s guilt or innocence with further deliberation. The foreman responded, “No. It is unlikely that progress can be made. We are deadlocked.”

Judge Murphy told the jury to order lunch then give it one more try.
