Lovato and Rodriguez Motion to Dismiss to be Heard Thursday

The motions hearing for Chaffee County residents Amy Lovato and Roberta Rodriguez will take place Thursday, March 30th.

Park County based Judge Brian Green will preside over the hearing. Judge Green took over the case after Chaffee County Judges Diana Bull and Patrick Murphy both recused themselves. Thursday’s hearing is to hear motions filed by Lovato and Rodriguez to dismiss the misdemeanor charges against them. 

Rodriguez is the former Site Director of The Schoolhouse daycare facility. Lovato was the Executive Director of the Chaffee Childcare Initiative, the nonprofit that ran The Schoolhouse. 

The two are being charged with failure to report child abuse or neglect and with knowingly placing a child in a situation that posed a threat to injury. The charges stem from a January investigation involving a young child’s actions toward classmates at The Schoolhouse childcare facility in Poncha Springs. As a result of the investigation, both The Schoolhouse and the Chaffee Childcare Initiative are now defunct, eliminating 24 daycare slots in the community. 

Thursday’s hearing will take place in Chaffee County Court.
