The attorney representing the Canon City man accused of fatally shooting his father in their home in January has requested the case be dismissed as a sanction against the District Attorney’s Office for violating rules of discovery and court orders.   

36-year-old Joseph Tippet has been charged with murder in the first degree in connection with the shooting death of his 72-year-old father William Tippet on January 6th.   

Tippet’s public defender, Adam Tunink, has filed two motions with the court outlining how the District Attorney’s Office allegedly is out of compliance with previously issued court orders. 

Tippet’s wife, whose name will be withheld because she is an alleged victim of domestic violence, told authorities that she left the residence the afternoon of the shooting to avoid a domestic violence situation.   

According to the arrest affidavit, she told authorities that her husband left a voicemail stating that he had shot his father two times. 

Tippet was taken into custody without incident by the Colorado State Patrol later that night in Salida.
