The 86-year-old Florence man who was indicted earlier this year on suspicion of causing the death of a 14-month-old baby in 1967 appeared in district court yesterday. 

Keith Emmanuel Smith was arrested September 7th in connection to the 1967 death of Roxanne Marie Archuletta. He bonded out of jail the next day. 

He has been charged with second-degree murder. 

Smith’s attorney, Karl Tameler, told the court yesterday that he plans to file motions regarding the grand jury asking how the grand jury was seated earlier this year. He also filed a motion to unseal an affidavit for a search warrant, which was sealed before the indictment, and he will file a motion for copies of the exhibits that went to the grand jury, including videotapes and other documentary types of exhibits. 

The DA’s Office will respond to the motions before Smith’s next court appearance which is set for February 5th.
