A new bill filed in the Colorado legislature would prevent employers form firing employees for using marijuana when off duty.
State law already prohibits employers from terminating employees for “lawful off duty activities, including the off duty consumption of alcohol,” but that doesn’t extend to cannabis.
The bill would clarify that the regulation applies to off duty activities that are lawful under state law, even if they are not legal under federal law.
It is unlikely, however, that this would apply to Colorado workers who have federal jobs.
