Herbert Lucas Scott, who is facing sexual assault charges in District Court, still has no attorney.  

It was anticipated that a new attorney would be appointed during a hearing yesterday but District Judge Patrick Murphy said there had been no response from the Alternative Defense Counsel regarding a public defender to be appointed to represent Scott.   

Scott’s former defense attorney Ernie Marquez withdrew from the case on September 21st. Scott’s first trial in August ended in a mistrial.   

The 11th Judicial District Attorney’s Office said it cannot appoint an attorney to represent Scott because of conflicts of interest. No local attorneys would take the case on.  

Another hearing has been scheduled for October 12th at which time Judge Murphy hopes to have an answer from the Alternative Defense Counsel.
